Man allegedly pocketed gift cards meant for customer refunds

A man who worked at Sam’s Club in Eagan is accused of swindling the store by pocketing gift cards he was supposed to give to customers for their defective tires.
The Dakota County Attorney’s Office has charged David Ross, 37, of Minneapolis with one count of theft by swindle.
According to the criminal complaint, Ross had worked in the tire department for two years and was allegedly being investigated for an ongoing employee theft.
Investigators said Ross would assist customers who had problems with their tires and complete paperwork for a refund. He would then go to customer service to have a clerk process the paperwork and issue a refund in the form of a gift card.
But instead of giving the gift card to the customers, Ross would allegedly pocket the card and ring the tires up as a sale without charging anything.
Ross used at least nine gift cards totaling $5,420 beginning in January 2009, the complaint said. The use of six additional gift cards is still being investigated.
Sam’s Club’s loss-prevention personnel were able to track the use of the gift cards and obtain video of Ross using each of the nine cards.
Ross allegedly told Walmart in a written admission that he used the cards for gas or food.
“I knew what I did was wrong and take sole responsibility,” he wrote.
If convicted, Ross will face up to 10 years in prison and/or a fine of $6,000 to $20,000.
